I had a total knee replacement in 2020. At about 6-9 months, I reported to the surgeon that something wasn't right. I applied for an increase due to a worsening condition in 2022 after the surgeon said that it takes 2 years to find out if TKR worked? I pushed and pushed the VA to send me out to another surgeon to evaluate the TKR. Almost a year of pushing, I was recently sent to a ortho surgeon through Community Care who found that I had a possible infection due to elevated numbers in my blood work PLUS he said that it appears that the spacer installed may be too small due to instability after falling in April '23. "MEPS medical exam noted: pes planus mild asymptomatic and vitiligo on body. SM on AD did see Army DR for right ankle and vitiligo. In 2023, Veteran applied for compensation. VA decided the following: service connection may be granted for a disability which began in military service was by some event or experience in service. Service connection for vitiligo is denied because the medical evidence of record fails to show that this disability has been clinically diagnosed. What to do when there are no records from private healthcare 1988 including the hospital involved due to doctors passed away or retired and hospital disposed of paper records 6 years from last encounter. those were pre computer digital age. the hospital also discarded images before 1999. VA care since 2008 and they did Xray and ct scan to verify conditions and now provide residual care but I have no info from the original treating doctors/surgeons. Had total laryngectomy do to cancer. Now im dealing with radiating pain down my legs from my lower back and head. (Injured my Coccyx at AIT lost feeling in my legs and lost consciousness. Ambulance had to back board me and take me to the emergency where i regained feeling and was put on walking dead duty) .

"I recently received my VA decision letter (7 Dec 2023). My claims were Tinnitus, Arthritis in neck degenerative w/radiculopathy, Asthma under the PAC Act diagnose Nov 2019 and Esophageal Condition (Dysphagia due to Schatzki’s Ring) (Secondary) to service-connected GERD w/Hiatal Henia. I retired from the Army in July 2007. I’m currently at 90%.
My decision letter gave me service connection for Tinnitus 10%, and 20% for Arthritis in neck degenerative w/radiculopathy. As for the Asthma they said, “Evaluation of sleep apnea with asthma, which is currently 50 percent disabling, is continued.” I was already at 50% since 2007. Why was Asthma added to sleep apnea and not rated under the PACT Act stated in my paperwork? The decision letter went on to say. “We have assigned a 30 percent evaluation for your persistent asthmatic bronchitis (history of chronic mild asthmatic bronchitis) (claimed as asthma) based on: Daily inhalational therapy and Daily oral bronchodilator therapy” Why was this not rated on its own?
As for the Esophageal Condition (Dysphagia due to Schatzki’s Ring) (Secondary) to service-connected GERD w/Hiatal Henia. The decision letter said, “The evaluation of gastroesophageal reflux disease (GERD) and hiatal hernia is continued as 10 percent disabling. The medical records fail to provide any evidence which would warrant any change in the previous decision. We reviewed the evidence received and determined your service-connected condition hasn't increased in severity sufficiently to warrant a higher evaluation. (38 CFR 4.1)”. I provided 5 Endoscopies reports 3 of which show a Schatzki’s Ring at the lower third gastroesophageal junction and a 3 cm Hiatal hernia. The Schatzki’s Ring has been dilatated three time to date. I also gave 39 pages of med records from my private doctor and VA doctor. That described Dysphagia, (persistently), I drink water after every bite to wash food down, trouble swallowing pills, meat, and chewy foods. trouble swallowing large bites, pyrosis (persistently) Pain discomfort in the chest after swallowing food (Steakhouse syndrome, a feeling of food stuck in your chest, recurring narrowing of esophagus and vomit/regurgitate (persistently). During the C&P exam I felt rushed. In the notification letter it said the C&P exam would be 90 minutes. I was in the examination room for half that time (45 min). What Do You Suggest." I was recently denied for 2 injuries in my VA disability claim due to a lack of service connection, majorly due to lack of STRs about those injuries. Have you ever seen a correlation between Viral Meningitis and Migraines? I had Viral Meningitis while serving in the Marine Corps in 2003, was hospitalized for several days and released. I initially put in a VA claim when I was first discharged and was denied due to now follow on symptoms (Not entirely true). I have been suffering from debilitating migraines ever since. I've had six blows to the head from military service. Only one (with facial trauma) is in my military records. I've got buddy statements for all my major head injuries. My initial VA claim for 'traumatic brain injury with affected vision' and 'right facial trauma' were denied. I'm currently having issues with my right eye. I wish to create new evidence for HTN. What would be the best procedure to record blood pressure. I have a BP cuff. I intend to produce a log, how often should I record my bP. How many times each day. How much time should pass between tests, should they all be taken seated? Or should I take 1 sitting, 1 standing 1 after exercise. What about non combat PTSD. pulled body of young boy who drowned out of ocean while on duty as air policeman and another case responded to horrific traffic accident and unknowingly transported a body to er, thought he was passed out and learned a few minutes later he was DOA in the my patrol car. Now have hearing loss both sides...1967 flight instructor found an 8 cent air mail stamp in my locker and said i was supposed to remove all valuables for the inspection. He sent everyone out of barracks and then picked up the stamp with his right hand and smacked my on left side of head hoping to stick the stamp on me. i have hearing loss and deviated septum on left side. he later warned me not to report it, he would send me to fatty flight and have to repeat 2 weeks over again. my bmi was 21 at the time. i did not report it to anyone but one friend and he has passed away and my family and they are gone. i told the VA and they gave me hearing test and found collapsed ear drum on left and hearing loss both ears. My question is dealing with VA rating for sleep apnea. On may last sleep study they recommended that I start using a BIPAP machine with oxygen supplement using an oxygen concentrator. "I have had 3 back surgeries, left knee replacement and an incisional hernia repair all accepted under a CA2 claim. I have hypothesis/parenthesis in the inside of my right leg, my hip flexors are damaged and other proven nerve damage. Had to have my right knee replaced also due to do my altered gate which is documented but OWCP told me I couldn’t prove it, at that time I didn’t know any better. I can not seem to find a doctor in my area that has knowledge of the 6th Edition AMA Guides. Under the FECA rules there is not a schedule award for the lumbar region damage but can be give due to the nerve damage to my lower extremities. The nerve impairment rating has to be done using the 6th Edition Guides Newsletter “Rating Spinal Nerve Extremity Impairment using the 6th edition. My neurosurgeon doesn’t understand this. My orthopedic surgeon doesn’t know the 6th Edition AMA for my left knee replacement to do my impairment but he says by state standards I have a 37% impairment. OWCP has sent me for nerve conduction test, and to their second opinion doctor. I have all of those results. Do you know of a doctor in the state of South Carolina that is versed in the 6th Edition AMA to be able to give me a correct and fair impairment rating. Sorry this is so long. My Dad’s (who is 85) supplemental claim for spilt patella/torn cartilage left knee was denied (after a C&P evaluator stated it was “less likely than not”) as his records were destroyed in the fire if ‘73. "I am writing in reference to a Nexus Letter for my PTSD, Sleep Apnea, and Migraines. I have already been approved of VA Benefits for PTSD at 50 percent, and I was already approved for Sleep Apnea by the VA doctor per home study of a CPAP, and Migraines by my VA Doctor.

Double mastectomy in NOV 2022, full hysterectomy in MAR 2023, arm lymphedema DX in OCT 2023. "You wrote a Nexus report for me to connect my service connected tinnitus to my obstructive sleep apnea. The examiner at my C&P exam opined that the OSA is less likely than not due to my tinnitus. She states that ""The conditions of Obstructive Sleep Apnea and Tinnitus are not medically related. The OSA is a separate entity entirely from the Tinnitus and unrelated to it. A thorough review of medical literature failed to demonstrate a causal relationship. A nexus has not been established.

Injured in 2017 at USPS, elbow fracture and a lot of arm strains. Had surgery in 2018, along with rehab. I mentioned to my doctor after my surgery about some numbness in fingers. He sent me for nerve study and found out I had ulnar nerve issue, he wrote it off saying it must not of been caused by injury or you would have mentioned it before. I ended up retiring in 2019. When I used to fly as a C-141 Flight Engineer, the Air Force would spray us with Toxic Chemical Pesticide every time we entered the US and at certain overseas locations. IAW AMCR 55-141, we had to stay in the aircraft for 30-45 min. until the aircraft was cleared into country. I have up to 100 exposures. Over time, and years, I have been diagnosed with Chronic Sinusitis and Chronic Rhinitis, along with OSA as a secondary. Additionally Fibromyalgia and Chronic Fatigue and Diabetes type 2. The VA refused to recognized my issues as service connected and rate me appropriately. "I intend to send you medical evidence for diabetes and CAD and HTN. I will need a nexus letter. I will be seeking a connection. my weight gain caused by inactivity due to SC injuries (Thoracolumbar strain) from my helicopter crash. "I was a combat medic in Vietnam in 1970-1971 and recently denied OSA secondary to my service-connected OSAD (Other Specified Anxiety Disorder), GERD/LPR, plus SSRI & PPI meds to help. I submitted an IMO & DBQ from a private Dr. along with a personal statement and buddy letters. I use a CPAP prescribed from the VAMC Sleep Clinic. In the denial decision letter, they have noted in their favorable findings that I have OSA. I’m also service-connected for tinnitus and hearing loss. If the HLR is denied, I know I can add new evidence by doing a supplemental but could I also add new evidence if I go to the BVA? 2. I served in the USAF in 1981. I was hit by a car while riding my bicycle during my lunch hour when returning back to my base on Watt Ave (McClellan AFB, Sacramento, CA) i went to the base's hospital /emergency and was treated for "contusion on head and left knee". I left the service in Nov 1983 and I initially filed for VA disability in Dec,1983. I received a denial letter from the VA in April 1984. (needless to say, i did not know or understand how to properly follow through with the claim, so, i was discouraged and angry, so, I went on with my life. within the last few years, i reapplied for VA disability. Since the car accident, I have had two arthroscopic left knee surgeries (1995 & 2005) and I currently have a meniscus tear in the same knee. So far, i am VA disability service connected for10% Tinnitus (2019) and 10% Eczema (2022). I have been told by the VA that I have to file a supplemental claim in order to discuss my contusion left knee and head injury. I have a DBQ on file for my left knee from a C & P exam (2022) but I need a Nexus letter to connect the dots until now. I sustained a work related injury to my right shoulder on 9/21/2020 (DOI). I retired on Full Duty status from Federal service on 07/30/2022. I reached MMI on 05/09/2023 (evaluated by Dr. Ellis' office). After submitting CA-7, my case was reviewed by the District Medical Advisor who later concurred with the impairment rating provided by Dr. Ellis. CBP Payroll has uploaded into ECOMP two different employee earnings statements, 3/4/2021 - 3/3/2022 and 5/9/2022 - 5/8/2023. The first statement reflects my base pay, overtime, and differentials while the latter is base pay only. It has been my understanding that a 52-week earnings statement is typically used to calculate compensation and it is based on the employee's earnings for the 52 weeks immediately preceding the injury; however, judging by what is currently uploaded in my ECOMP that doesn't seem to be the case. I served in the Army from 86-89 as a combat engineer paratrooper. I was involved in an in-service training accident. This accident involved the hatch on an APC collapsing onto my head rendering me unconscious. I am rated for migraines and TBI. Currently awaiting a decision letter on several claims from Jan 31, 2023. Because of a domestic abuse situation while join-spouse in 1978 my active time was less than 2 yrs. While in BMT had severe shin splints but requested release from restrictions to avoid set-back and be "the example" as I was dorm chief. At the QTC gen med C&P the doc said not service connected because "shin splints resolved" and no further treatment sought. Other issues are documented after that encounter, including bilateral tibial muscle strain and low back pain. Being in the abusive relationship I was prevented from going to clinic so bruises would not be seen. Every appt was accompanied by spouse, except for the psych which was unannounced and to which I was taken by another member of my all-male shop. Clinic visits were mostly for frequent UTIs (spouse was "friendly" and he needed to go as well), and OB appts as those were scheduled. QTC psych doc was amazing and I expect 70% based on the copy of his report. Also tinnitus was confirmed as I worked flightline. I need SC for the shin splints which have continued, and resulting knee pain with left total knee replacement in 2020. I am allergic to metal and the device has nickel hardware so continuously painful. I have no plan to repeat the pain of TKR again so I will just deal with the pain on the right since the left one still hurts anyway. Already planning to file for OSA since I use a CPAP, and the weekly migraines which I have tracked for two years. Unfortunately, my USAF med recs are very skimpy, barely legible and came to me all jumbled and messed up. "I had the gall bladder removal surgery while I was active duty in the Army at the age of 18 in 2001. Since then, I have been experiencing what I believe are post cholecystectomy symptoms that includes Gerd, Chronic Diarrhea, frequent bowel movements throughout the day, Excessive gas, nausea, occasional vomiting, abdominal pain and cramping.

"I was a US Army Flight Surgeon and Fort Hood Powerlifting Team member. I have a 40% rating for a seizure disorder which began in the army in 1987 or so. During my out-processing C&P exam (1989) a doc at the Daytona Beach VA listened to my heart, did reflex testing, and said ""10% non-compensable for knee pain"". I told him of my symptoms during the army and that some sort of brain malfunction was going on (documented in my MR). He did not address any of that. No one said ""appeal "", ""VSO"", or ""DAV"". I just went on working as a civilian. Fast forward to 2006 when a series of major seizure activities occurred. That is when I found out that I was found unconscious 3 times by a friend while on active duty. So by the grace of a buddy statement, and me finding one note from an army neurologist, I finally got a 40% rating, almost 30 years after its occurrence on active duty. Like you sir, I am a physician. I think the brain controls how I can perform my job. 40%? Really? Recently I got a 30% rating for PTSD. It must be the new math, but 40%+30% doesn't equal 60%, except in the VA.
I would like a NEXUS letter linking my tinnitus to the head trauma which occurred on the Fort Hood powerlifting team which caused or exacerbated the seizure disorder. Perhaps the tinnitus can be related to PTSD?
I also have tremors which began after the big seizure in 2006 and they are getting worse. Makes it difficult for me to suture anyone, let alone insert my contact lenses.

When deployed to OSAN, KOREA in 1975, Ninety days from discharge got drunk downtown while having sex I had intercourse so long I rub all the top layer off my penis. I am a physician, USAF veteran, (cardiologist) and former FS, working with a widow (close friend) of a deceased Vietnam Navy Vet who passed away from GBM and am trying to secure DIC benefits for her. Veteran also had DM-II, HTN, Prostate CA and CAD (stents) all 4 on the presumptive Agent Orange list. HIs ship stopped in Guam on 3 occasions (deck log proof) so should be able to SC everything except the GBM which is not a presumptive for Vietnam Vets but is on the List for Gulf War and post 9-11 veterans. I was issued a heavy piece of electronic equipment which was loaded into my car by VAMC staff (less than 3 years ago). I herniated a disc lifting it out of my car (MRI scan done). In my initial RA, Reasonable Accommodation (at 29 days), I documented the injury was related to the equipment and I have this in email to my Supervisor. I then retracted this RA and sent in a different RA because I was afraid the VAMC would blame my Supervisor and/or the VAMC staff or me. Do I still have a OWCP claim? Both knees and back accepted claim USPS 25yrs. I needed arthroscopic surgery to both knees, and with first surgery I developed a clot and Pulmonary embolism. I'm trying to get an upgrade to claim. "1. I am a 65 yr. old female Veteran Air Force Nurse. I entered Active Duty Service July 8, 1987.
2. While on Active Duty Service, I was involved in a 3 car auto accident in 1988 where my vehicle flipped over and landed upside down. Sustain multiple injuries: cervical, thoracolumbar spinal injuries, whiplash, upper back spasms, left elbow open wound, left thumb torn ligament, bilateral knee injuries and pain due to dropping to the floor of the upside down vehicle from a locked seat belt which had me suspended in the air of the upside down vehicle. When I released the seat belt, I dropped to the floor of the vehicle into a pile of multiple broken glass which was on the floor of the upside down vehicle.
3. I was discharged from Active Duty Service October 26, 1989 with a honorable discharged.
4. VA denied 2 disability claims (12/2013 and 11/ 2022) for DJD, severe Arthritic Knee Joint disease with bone spurs in both knees. I had a Total Left Knee Replacement 10/2012 and a Total Right Knee Replacement 8/2018.
5. The Georgia VSO states I need a Nexus Letter to prove Bilateral Knee injuries are Service Connected.
6. All of my injuries were from the same 1988 Auto flip over accident.

Lung cancer right lung removed at age 42 in 1988 17 years after discharge in 1971, my private doctors who were on the case have retired or passed away and there are no records. back then it was all paper. there was info in there concerning toxic exposure in Okinawa and also Patrick AFB. "I was in the Air Force from 1973-1977. I was stationed at Elgin Air Force Base in Florida and never really had a need to seek medical treatment for any major conditions. I was enlisted as a carpenter and had various jobs while enlisted. I was exposed to loud sounds such as, but not limited to the following: machinery, pneumatic tools, hammering, circular saw, rotary saw, table saw and other various tools needed while performing daily duties. Many of these jobs also required demolition of flooring and walls, most of which had asbestos. There were no ear plugs respiratory safeguards that were required or even given to us at those times.
After I had served my four years in the Air Force, I left early and never had an exit exam or medical physical upon leaving. About a year later, I was hired as a letter carrier through the US Postal Service where I worked for 35 years. Upon being hired, the postal service required a complete physical in which I was informed that I had developed a hearing loss as well as some beginning stages of tendinitis. At that time, I really hadn't noticed anything substantial as far as my hearing loss or signs of tendinitis.
As of late, I have been able to obtain all my service records from the Veterans Administrative National Archives, but I have had some difficulties in obtaining my personal records from the US Postal Service.
In 2016 I applied for enrollment in the VA Health Care program through The Department of Veterans Affairs but was denied processing of a claim due to no service connection or correlation. This was likely due to not being able to provide any records from the US Postal Service.

My situation is complicated Doc. I was discharged with 100% disability for TB 57 years ago. Put on the TDRL list. (Temporary Disability Retired List). Over the years my rating was cut to a Q rating. $67 a month. I never was examined and didn't care because I thought my disability would be a negative for any future employment. Then about a year ago they started paying me $165 monthly and gave me $8000 with no explanation whatsoever. I assume that's 10% rating and backpay maybe? I'm on oxygen for several years now. I also had a lower back injury. I lost my grip and foothold on an airplane while strapping in a pilot. I landed on my tailbone. I was a Plane Captain in the Navy. Now this wasn't on a carrier but a Naval Air Station on a concrete tarmac. Before my TB diagnosis I was exposed to a lot of jet exhaust fumes. . We would purposely get in the exhaust to warm up in cold weather. In bootcamp I was purposely exposed to smoke in Firefighting School and teargas. They made us remove our gasmasks to breathe the teargas. Instructors got a big laugh from that. Back in those days they were handson. Got physical with recruits. I've had several surgeries in VA medical system. Hip replacement, shoulder replacement, 3 eye surgeries on same eye (which they screwed up), umbilical hernia, just to name a few. Sorry to ramble on. I have SC sleep apnea and Tinnitus. I am considering filing secondary claims for headaches, back/neck pain, including radiculopathy, and mental health. Are you able to provide NEXUS and DBQ's for each of these conditions? If not, do you have referrals for someone who does? I entered the Marine Corps in 1979 and spent ten years running on feet that were bowed and clubbed at birth and were treated with braces, casts and corrective shoes for the best part of my first ten years as a child. I am a veteran of the Army National Guard (artillery), Navy (hospital corpsman in Marine Corps Infantry Battalion), Army (medic), and Air Force (Medical Service Corps Officer). I left service in 2006 with 12 years of active duty and 16 total years of uniformed service. In 2005 I was deployed to Balad, Iraq. I just filed my first two claims (1) sinusitis & rhinitis, and (2) tinnitus. I have a number of other conditions that I think I need to apply for (was just diagnoses with sleep apnea and pick up the CPAP next week). I've ordered my service treatment records and are waiting to see what is in them. As a medical much of my care was provided curb-side and largely off the books - or I didn't mention it because I didn't want to be judged by my medical colleagues - I didn't know any better at the time. In 2001, I had a severe neck injury while on the job as a Federal Probation Officer in the District of New Mexico. At the time I had a Federal Workman's Comp claim number and was out of work for about a year. My LEO position was threatened by the Chief of Probation at the time that if I did not return and pass my FIT for duty examine my position would by terminated. I returned to work earlier than needed and passed my FIT. I have never closed my WC file. I have been a Federal Employee to the present. My injured neck has become very painful once again, I recently was referred to have a MRI of my neck, the bad news is that the injury area sustained in 2001, has gotten worse to the point of requiring neck surgery to relieve the pain and numbness in my arms. I have one condition that was not service connected from a 1990 claim. My knees. The rater said that the evidence did not show left knee pain. "My employer is telling me to not file my first CA 7 form until the 45 day of COP has ended. CFR 20 10.111 States i should file after receiving the CA 07. Now the OWCP adjuster called and stated i cannot keep submitting my form. This was denied due to employer has not confirmed ""leave without pay status"" and ""unable to verify future dates"".

I filed claims for asthma, cervical neck strain, headaches and PTSD due to MST. These were all denied despite having buddy letters and notes from my private primary doctors. I'm a retired Air Force Chief Master Sergent with 30 years of service, discharged in October 2000. In 2017 I was diagnosed with Parkinson's disease. I submitted a claim to the VA and was denied, which I believe was a result of not having a nexus letter. I have an accepted OWCP claim for COVID pneumonia that had me hospitalized back in September 2020. Since then, I have aggravated breathing issues. Would I need to get a impairment rating for my amputated finger? It has been amputated at the second knuckle. I have about half my finger left. I got PTSD during a hospital stay at the VA (long story). I am having a great deal of trouble getting anyone to take me seriously. I was never able to get a proper evaluation. Now, they went from saying there was nothing wrong with me to saying that I am too fragile to undergo the method of treatment that the VA uses to treat PTSD. Do these fair laws help veterans get treatment after they have won their disability rating? I have been trying for years to get a congressman involved, but after I fill out the consent form, I never hear from them again. OIG is not interested either. So doctor at Ellis I have a couple questions the first one is I'm a veteran Marine Corps served 1977 to 81 and got out never applied for or received any disability at the time. Since I have applied for and received tinnitus at 10% and both my knees at 10% each and now stand at only 30%. I have two cases before the board one is for migraines and the other is because I'm crazy for my mental problems whatever also I have one case that is working through the system currently for sleep apnea connected to my tinnitus and my late knees. I have had an aggravating back problem for years and years and years but in 2019 while over in Baghdad working on contract for the state department I had nightmares or sleep fit or something I ended up rolling out of bed and hurting my back that was in December 2019 I came home I have had two back surgery the last one was December 1st of 2022 I have a cage in my back from L5 to L1 including S1 and a wedge through my stomach into my back I am conflicted on if I can still claim my back under the VA or not. I guess the other side of this is while working overseas as a private contractor after getting hurt I came home and I am on workman comp it is based off a long shoreman something I'm not real sure exactly how it works but I'm getting close to where they're going to want to do a settlement and I'm not sure if that's the best thing to do or can I make them continue paying me monthly my workman comp until I die. "I'm an 80 year old veteran with a VA disability rating of 90%. Two of my disabilities are related to an in service lumbar surgery in 1992: 10% for L4-5 Herniated Disc and Lumbar Degenerative Disc Disease, and 0% for Residual Scar, Laminectomy and Discectomy. Both are Service Connected.
My Virginia Department of Veteran Services VSO has advised me to file for disability due to Multijoint Arthritis (5002) secondary to my above listed rated disabilities. I have recent x-ray and MRI results that clearly show arthritis throughout my lumbar spine.
I've read the CFR38 many times and can't figure out if the VSO advice is on target. Both of the Dr responsible for the x-ray and MRI give me a diagnosis of Degenerative Disc Disease (Old Folks Disease) and won't consider my back surgery as potential causal factor of my arthritis.

I appealed the OWCP Formal Decision on my scheduled award for hearing loss after noticing several blatant errors in their decision letter. I requested a hearing with a representative of the OWCP and the hearing took place on March 8, 2023. The case was transferred to the Branch of Hearings and Review and the decision of the Hearing Representative was issued on April 10, 2023. The Hearing Representative vacated the decision by the OWCP in its entirety based on testimony and evidence and remanded the case back to the District Office. As of today, I have not been able to get any updates on the status the claim from my case examiner. While driving the submarine as a helmsman, a radio operator was in the bridge working and he dropped a 4lb wrench, which hit me in the head and I was removed from the seat, because I was unconscious, the Hospital corpsman informed me, when I woke up I had several stiches in my head.
Also, in the same timeframe I fell and hit my head on a missile tube.

The USS Blueback had a fire on board, while fighting the fire my EAB was disconnected not allowing me to get air, as I was leaving the scene to get a new EAB, I hit my head on a watertight door.

In 1979 I had a neck injury from slipping on ice I have that in my records from when I was in service, and while in Korea I had a jeep accident and a TBI out in the field all I have is an accident report but was never seen by the medics. thru the VA I a diagnosis with a mild TBI, around 45 years old I started having problems from my cervical to my lumbar with radiculopathy in 2010 @ 51 years old I had to go on SSI-D due to my conditions, and I have never been in any accidents since I got out looking back on all this I have had balance problems not dizziness but a feeling like I'm clumsy also tearing my meniscus while just walking had surgery in both knees, is this something you what write a nexus for? and I see mental health for panic attracts depression and insomnia for 20 years. also I get steroid shots in the lumber thoracic and cervical for years I have all the documents. I have open claim but my Dr office quit dealing with OWCP my Dr died 2 years ago the Dr that took over never got referral done right she left clinic and that's when they stopped dealing with OWCP. I have service-connected shoulder injury (clavicle, torn ligaments, bursitis, shoulder separation) 1973 Marine Corps. Recently diagnosed with severe PTSD at Mental Health, Ft. Meade VA medical facility in Sturgis, South Dakota, and another diagnosis of the same from an Indian Health Service (IHS) doctor who specializes in Mental Health from Rosebud, South Dakota. The IHS medical opinion provided a positive connection between service-connected injury and PTSD. Filed depression (PTSD) and tinnitus with local VSO for compensation. VA diagnosed me with tinnitus. Again denied claimed I healed fine and he couldn't see scars through my head of hair I guess. Again another denial. Law firm looked at my denial letter and refrained from helping me with old claims and they mentioned if id be interested in a tdiu claim but I'm only 10 percent connected now so they said they again couldn't help me. I recently filed for a new Tinnitus claim and they called me and added headaches to the claim my wife's buddy/spouse letter mentioned my headaches so they added it plus I mentioned it on the Tinnitus claim at C&P exam. I am getting ready to apply for a increase for my neck it's been 30 plus years and I gotten radiopathy in my hands. My flare ups get really bad some days. Finally insurance approved for a MRI I had to do 6 weeks of Physical Therapy first before they would reconsider so I did that as well. MRI was done and they are about to do a CT scan on my neck soon. Local neurologist wanted to do surgery immediately but when I mentioned a second opinion using a newer technology Sonic surgery less invasive than fusion surgery. Well he had me see his physician Assistant first she gave me the speal showed me my MRI then left after I mentioned second opinion made me a appointment following week to see actual doctor. He said he thinks I have carpal tunnel in both arms instead put in for a CT scan and now wants to do a EMG test on my hands. I'm confused. I also been suffering from gulf war syndrome since service. Fibromyalgia, chronic fatigue, I.B.S. , rhinitis and/or/siinnitis. I been going to a local psychology place. They diagnosed me with P..T.S.D. and anxiety so I need to try filing but for non combat I guess since I was on the Nimitz and a fighter jet hit round down crash landed serious fire on deck. All planes on deck was loaded with every kind of armament. Phoenix missiles side winder missiles, cluster bombs bunker buster bombs you name it and nukes onboard the ship. So I did fear for my life and all aboard the ship. It could have caused a chain reaction and we all could have died.
I also suffer from GERD as well. But I am really having a hard time getting diagnosed with chronic fatigue I have tried several times with several attempts to get diagnosed. But never have been diagnosed with it yet all these years that's what I been suffering from., Since desert storm. I am diagnosed with asthma but now there sending me for more tests I already did the four PFT tests they came back pretty good for being a smoker for 32 years plus but I recently quit for Mom. But now they say I don't have C.O.P.D . So he is sending me for another type of asthma PFT testing I guess. I get really short of breath in the heat when I get exerted by climbing stairs especially with groceries or mowing yard even I have bad asthma attacks. I am also scheduled for a in house sleep study test I had the home type but it didn't reveal anything. So idk to be honest. Last couple years my neck pain and arm and hand pain is affecting my ability to drive and work and I drop things now. much more so, especially on severe flare up days I'm pretty much home bound from it. "Mine is a complicated issue. To be as brief as I can....
I'm a Peace Corps volunteer who was never fully evaluated for a fall (while in service) in 2017. A missed fracture of spine and hip was dx in 2018 upon return to USA. I did have DOL spine fusion and should be getting a new hip (PT helps but approval for that is inconsistent. I'd like to wait for hip as long as possible)
Questions...
1. How may I get a full evaluation (is it even possible after so long?) Also, you may know since this occurred out of USA no lawyer will take my case and Gov may not be sued. But it also means not getting full care I need.
2. What about disability? No idea what that benefit is or when to determine eligibility. Agency is Peace Corps. They've given me the run around.
3. Finally, surprise, I'm a senior (59), and also wonder about retirement. At one point I found something online (CFR) that work comp counts for years of service (even as a volunteer. In these circumstances PC volunteers are employees. Crickets to this question from the agency too.
At the moment, i have a DOL claim for dental (2 front teeth implants this will take another 7 or so months. Due to getting screws put in, in March-ish), and one for psychological. Needless to say, I have PTSD.
These should be one claim but they're 3. Agency screwed up. Here's the kicker, DOI is listed when I was back in the States. I filed an administrative claim (now DOI saying here and not overseas). They denied saying outside the country... no lawyer so, it died.
Oh and requests for transportation reimbursement denied!!! I have travel to be reimbursed since 2020. This triggers my PTSD (it all does), and I shut down. Haven't attempted resubmittal on pre 2020 which I'd already done once.
Those are the highlights. Would love some guidance navigating all this. By the way, I'm a single woman with no help either. It's disheartening and emotional.

I have a legal question about VA disabled for respiratory system under 38cfr 4.96,4.97. My code is 6819 but it does not say anything about outpatient oxygen therapy. In 4.97 the list of codes 6833 is the first-time outpatient oxygen therapy is a requirement, I am on oxygen therapy for the rest of my life. I have a nexus letter and is for asbestosis exposure when I was on board the USS Sierra (AD-18) commissioned in 1944. I was a machinist mate in the engine room. He has been out of work since August 2023 due to exacerbation of injury and filed a CA-2. Now it's in Reconsideration since it was denied, due to the DOL overlooking the 5th key element.

"Hi Gary, Thank you for the response. I finally heard back from the VA Compensation. I was denied my hearing loss, they only connected my left ear at 0% but not my right. I was at the VA hospital in Phoenix yesterday so I stopped by the Regional Office since it was nearby and was able to talk with a representative, who looked up my medical records from active duty (I had also requested a copy last year, still awaiting them), she saw a notation in my file for only the left ear diagnosis, not the right which seemed odd since I would have thought hearing loss would be similar for both ears. She stated that's why they denied my compensation for hearing loss, I asked if I was to get a Nexus letter if that would suffice, she thought it was possible it would have to have the verbiage which connects both ears degrading at same levels. However, it's only at a maximum of 10% so it may not be worth it. In addition, she did see I would be service connected for flat feet which has been an issue for me for many years now and currently diagnosed with a predatory doctor at the VA, shin splints was also an issue while on active duty as well as migraines which has been a really bad issue for a while now. I also have a current diagnosis for it as well. When it comes to my hypertension, indeed it has been an issue since being on active duty and still being treated today, however apparently the doctor who did my intake physical at MEPS noted I had a ""family history of high blood pressure"", the representative thought I may not be able to get compensation for it due to the verbiage which would be perceived as a prior history.
If there's any way you can assist with the hearing loss in the right ear (with loss of hearing being equal to both L & R) or would I need to contact an Audiologist? Also in regard to my hypertension from active duty service which is still an issue today. I appreciate any feedback which would definitely be helpful.

Doc Ellis, my name is Norman. I have a service connected disability to asthma. I started with 10% back in 1991. I put in for an increase a couple of years or so later. I was awarded 30%. In 2007 I went to my Primary Care Dr. He wrote a letter to my Postmaster about some restrictions that he put on me because of my Asthma. My Postmaster said that I had to go out on disability retirement. So, I did! I tried to get another increase because I was forced into retirement, not that I wanted to. I was denied again. So I have put in for another increase again (2023) under the PACT ACT. I cannot put in for unemployability because I am only at 30%. I have also been put in for other illnesses, which I had no idea that I could do, until the pact act went into effect. I was stationed in Turkey and had gotten my asthma there because of coal dust. My adult son joined the Army, while in BCT and hurt his back. They discharged him citing pre-existing condition scoliosis. The VA denied the claim because he was in less than 180 days.
He has struggled with the back for years now and has prevented him from holding down employment. It has reached a point that I am seeing an emerging depressive DO. He is withdrawn and isolated. I feel the two are connected. I am an LCSW and while I can’t ethically treat my son am very concerned.
My question is: is there any avenue for a VA claim for the back injury? I feel like if Scoliosis was present at entry, it should l have been caught at the MEPs. just not sure where to turn to help him.

I was at the clinic Sept 12 and got Nexus letter for OSA/CPAP for a new claim, but also for migraines, ortho and back issues. Submitted for the new and supplemental claims on Oct 11th. VA scheduled C&P at their clinic for OSA/CPAP. Doc was very nice and only wanted to see my last sleep study that I did have w me. Asked NOTHING! OSA denied on Feb 15 for no evidence of connection between GAD and Tinnitus. Fortunately, the migraine claim was finally approved on Feb 20, with everything else deferred. I had a C&P for Gen Med on Nov 4 and took the Nexus letter w me. I Showed it to the PA and he asked for a copy. He must have just copied or agreed w it (Haven't been able to get a copy of the C&P exam), did have multiple x-rays and a couple ROM measurements and now I am scheduled for another C&P on Feb 29 for shin splints. Suggestions for supplemental documentation on the OSA claim or just wait until ortho finally is approved and tie OSA to obesity? Good news is now at 90% (87% actually). "In 2006, I underwent shoulder surgery due to recurring dislocation, unrelated to workman's comp. Shortly after returning to work, a coworker purposely bumped into my shoulder, which raised concerns about potential re-injury. This prompted me to file a workman's comp claim, despite having exhausted my leave balance due to the initial surgery, I wasn’t offered the initial 45days off. Also, Unfortunately, I did not apply for a Schedule Award (SA) or undergo a Maximum Medical Improvement (MMI) assessment at the time, as my employer provided minimal guidance. I did not know what was going on. I couldn’t stand the dislocation. I feared it. Consequently, the case closed in 2011, despite ongoing issues with my shoulder. Over the years, my shoulder condition has worsened, causing me constant fear and discomfort, affecting my daily life and sleep. Surgery is not an appealing option, given the challenges of the initial procedure and subsequent dislocations.
Additionally, eight years later, I experienced another workplace incident where I sustained wrist and neck injuries while lifting a heavy box in the mailroom. Despite undergoing eight months of physical therapy, the MMI assessment awarded only 2% for my injuries from the second opinion doctor, and the Department of Labor (DOL) granted compensation for only two months. My wrist and shoulder gave out. I lost control of my grip this case could stem from my shoulder injury case. However, my case closed five years later, yet my injuries persist. My employer is giving me a hard time with re-opening my first case. I do not want to have the same issue with the second one.
Furthermore, in a recent incident, I sustained ankle injuries while reaching for items on a high shelf to feed detainees. Despite ongoing therapy and medical care for the past 13 months, including 6 injections, my ankles remain swollen and painful from nerve damage and from the way that my ankles caved in with my heavy work boots on it caused nerve damage. I am currently awaiting a second opinion from DOL doctors next month, as surgery is not a preferable option due to potential complications and an uncertainty of not fixing the issues.

"I was out on OWCP in Nov 2014-March 2015 getting paid by OWCP, due to life altering injury.
My federal employer (2) denied my request for permanent disability and ordered me back to work. I went 5 months without pay after that, when I tried to go back onto OWCP.
The doctor wrote a letter and stressed I should be on desk duty. Federal agency denied his letter and told me exactly what to write and submit.
I applied in March 2017 for permanent disability (via Harris Federal) and my agency held my paperwork for almost six months but told me they submitted my paperwork. It came from a gov’t legal office lawyer named N. Hankey. I have a letter from Harris Federal inquiring about the status of my paperwork in April 2017.
Personnel employee Trish Allen would send me an email (Nov 2017) and stated words to the effect , "" i found your paperwork and submitted it to DOL"", sorry for the inconvenience"".
My supervisor lied about my injury and failed to mention I had difficulty with training over the next two years.
DOL took the gov agency statement and discarded my hand surgeon's statement about the extent of my injury to deny me.

"I am 62 yo male Physician Assistant for 32 years. I just quit working because of severe right lower leg pain from knee down to my toes worse in calf and across top of foot. I have been evaluated by doctors and do with CRPS following fracture dislocation of ankle. The surgery was fine, but the pain progressed. I also have low back pain with, lumbar radiculopathy. I have two inches of atrophy between my right calf as compared to left. I can only stand or walk for 20 minutes at a time. Then I need to sit in recliner with leg on pillow. currently on Lyrica 200 mg bid, , buprenorphine transdermal patch 10 mg weekly, lidocaine patches on leg. Pain significant. I drag my foot at times fall around 3 times a year if I step on a small rock or uneven surface. I retired 12/25/23 as the pain is too severe. The only thing that helps pain is heat and sitting reclined with leg on pillow in recliner. I don’t feel safe mentally to work as a health care provider. I have worked since age 16 with no gaps. Applied for SSDI got back my denial apparently the SSDI doc that spent a few minutes on my case feel I am safe to continue working as a PA according to denial letter.
I am wanting to fight it but not sure it is worth it. I am100% SC from VA for my radiculopathy, Combat PTSD, shoulder, and wrist motion from injuries in Afghanistan,

"My name is James, I served on active duty from 1982-1985, as a US Army Military Police Canine Handler. I also served several years in the US Coast Guard Reserve, as a Port Securityman. I am a 10% SC veteran for Tinnitus, effective date of SC was 07-01-2019, reference my time in the Army.
I was administered sleep study tests, on 11-06-2013 and 11-13-2013, by a civilian pulmonologist and was diagnosed with Sleep Apnea. I was placed on a CPAP. Fast forwarding, I was administered a sleep study on 02-01-2023, by the VA, and diagnosed with Moderate Obstructive Sleep Hypopnea Syndrome. I am currently using a CPAP given to me by the VA. My BMI estimate, by the VA, was 48.2 prior to my sleep study.
My first question, is there a reasonable expectation that I can get service connected, as a secondary claim, related to my OSA? Will my high BMI disqualify me, if I were to submit a claim? I am suffering with off and on headaches, insomnia, depression, anxiety, and irritability, because of the constant noise associated with the tinnitus. I have not been diagnosed by a physician concerning the off and on headaches, insomnia, depression, anxiety, or irritabilities.
The Tinnitus noise basically never goes away and it is hard to fall sleep. I’m currently taking 20 mgs of Melatonin, in conjunction with other over the counter sleep aids, almost every night. I also wear hearing aids, given to me by the VA, which emit static noise into my ears. The static noise helps some to assist in cancelling out the noises associated with the Tinnitus. I wear them almost every day unless I’m doing physical hands-on work, such as cutting the grass and so forth. My hearing, as rated by the VA, is WNL and was denied a hearing loss rating.
If Dr. Ellis believes there is a reasonable expectation, of being granted SC, because of the OSA secondary to Tinnitus, I would be interested in talking to someone at your clinic about the process of being seen. I live in Mobile, Alabama, and it would be a long trip to the clinic. Would it be possible to be seen via telehealth over the phone or computer? My biggest concern is that my BMI may exclude me from being service connected. I am currently taking medication from the VA for Essential Hypertension and High Cholesterol.
Also, I was attacked by an Army Sentry Dog, in June 1984, at the Depot I worked at in Germany. I received several puncture wounds and scratches on both of my hands and forearms. The puncture scars are small and when touched, have small depressions. Some are difficult to see. Is this worth filing a claim over reference scaring? I was treated for a few weeks at a military clinic. I presently do not have copies of those medical records pertaining to the incident and treatment of my injuries. I do not have a PCP but I went to Patient first office on 2/7/24 and the first doctor did not do anything, did not dress my wound which got infected and I had to go second time there and a different Doctor dressed my wound but did not write a note for me to be off from work instead she wrote light duty till 3/12/24 and resume regular work after 3/12/24, she also wants me to go for physical therapy for 60 days from 2/26/24. I have an Annular disk bulge at L5-S1 with disk protrusion which occurred in 1999, that's VA rated @ 40%. Separation physical also show radiculopathy, but the VA has not rated me on that for some reason. Because I'm not able to exercise, I've gained weight since I left the service. Sep physical shows weight @ 185lb and I'm currently 220. @ 5'-10" I fluctuate my BMR between 30%-33%. I have developed Hypertension, Sleep Apnea, Diabetes, and chronic kidney disease. I am looking for a Nexus that can show the intermediary link from the SC disability to Hypertension through the intermediary link of Obesity. My individual doctors will link the sleep apnea to Hypertension and obesity. My Primary physician will link the diabetes to the Hypertension and the sleep apnea, and my kidney doctor will link the kidney issues to Hypertension and Diabetes via the DBQ. "I have a buddy who got a schedule award 15% impairment several years ago on a shoulder he injured working at the post office. I retired in back 1996 with ratings for flat feet of 10% and lung lobectomy for 10% for total of 20%. However, the VA started treating me for Diabetes and CKD around 2002. I'm now in CKD stage 4 and during my time had a history of Kidney stone on active in the late 70's and when serving in Germany in the 80's. I work for USPS in Tulsa and was hurt on the job Feb 8, 2023. It's been ongoing. I have been on light duty since January 2024 and management wants me off of light duty NOW. I have lost 80-90% of use of my shoulder and arm. All my doctor is doing is giving me a CA17 every month and not helping me at all. He was infuriated that I asked for a detailed summation/narrative report, because he said he already submitted it. ECOMP called me telling me that they did NOT have anything from him, nor did they know why I was even on light duty. I haven't been paid one dime for anything, ever. I pay for all my medications, use my own personal Annual leave to cover all the time I've missed. I've told the doctor my urgency in the fact that my mobility is next to zero and numbness is from my armpit to my fingertips.
I am an army of 1 and I know nothing of how to navigate ECOMP. They are preying on my ignorance. My supervisor is harassing me to get this done so I can go back to his department. A friend told me that she heard that I am a running joke with the supervisors there as being a fraud. I am faced with quitting my job because there is no place for me to go as a mail handler and cannot handle the ridicule much longer.
I know this probably won't be seen by Dr. Ellis, but thought I'd just throw out a Hail Mary before I hang it up.

I passed my enlistment exam and spent 3 years in the army at my ETS physical in January of 75 they said I had a heart murur and called it a natural physical abnormality and did not qualify for any disability, which was fine with me I was 20 years old and felt fine in 2002 I passed out on the job and was taken to the hospital and had to have an emergency Aortic valve replacement, and again in 2008 because of endocarditits and again in 2020. My native valve was a bicuspid valve and I was told by the doctor that physical activity would have caused it to fail sooner. during my last year and a half, I was the company physical training NCO and had to run and lead calisthenics 5 or more days a week. after my third heart valve I filed for disability, because I felt that they must of missed the murmur at my enlistment or it was made worse by my physical activity during my time in the army. I went to your clinic on May 22,2024 and I had 4 Nexus letters done for by your associates ,they were great. My cases are still pending and I Thank you for helping. My new question, is there a connection between osteoarthritis , DVT, PE and a mild stroke ? I had a recurring blood clot in my RT knee . It had been discovered back in 1/2022 and treated by the VA for a year and on May 13th I had PE and a mini stroke episode . Only by the grace of God, I am still alive. Tinnitus that's exactly what I have. They denied my hearing loss even though on my ETS physical, it was noted that I had a mild hearing loss they only approved 10% for tinnitus And disapproved my hearing loss, which I have been suffering with for years on top of that I have vertigo and sleep apnea I want to know if I should file a claim. Hello Amazing Ellis Clinic! I came to visit you all last year under a misdiagnosis of Lupus but was off work with with work related cervical & lumbar ridiculopathy, since that visit OWCP tried to send me back to work no restrictions after 2nd opinion & referee exam in March although as i struggle to barely be seen by you all same was true with them, & unfortunately I completely lost mobility was hospitalized in April of this year after bedridden with urine catheter. There is a usps EEOC lawsuit USPS NRP lawsuit. Waiting on judge decision soon after a long case since 2006 law firm Thomas and Solomon working on behalf of USPS injured workers. Hi, Dr. Ellis. My claim was finally accepted after 10 years on 10/24/22. So the USPS was told to pay my back COP. However, they refuse to do because due to the length of time. But the claim examiner said I proved that I was injured so pay me. The lady was still defiant. So the claim examiner said to get an attorney. Is the claim examiner correct? Hello Sir, currently on owcp compensation. I am on total temporary disability for 2 years now and currently receiving treatment. Owcp scheduled me for a second opinion and the doctor agreed with my treating physician on total temporary disability and not work. He also stated that I was mmi on his report. I also applied for FERS disability and got approved but chose to stay on owcp for now. My question is, what’s next? I work for Homeland Security and was injured on the job which required a TKR in 2/28/24. Since the operation I have now have been diagnosed with Lymphedema in my left leg (Stage 2) along with several venous insufficiencies. This is an approved claim and I’ve been out of work for almost 2 years. I have been told that I will most likely lose my job because of the injury and that I’ve been away from my job for 2 years. Been suffering dizziness for last 20 years in relation from a head injury from motor vehicle accident in the military and possible loud noise exposure since my role also was unit armor which required my presence on the range one week per month. Hello Doc Ellis TEAM, I am from Virginia and several years ago I had 15 claims (1 submission) denied by the Roanoke, Virginia VA. Even though I possessed a Line of Duty for my left knee, and had other medical documents from my military record. I got out in 2014, but didn't submit my first claim until 2021 I think. I also suffer from severe sleep apnea, severe PTSD, tinnitus, etc. I only have recent (last 3 years) medical paperwork on these items. I currently receive a VA rating for my foot. It this something you do, provide Nexus Letters (legitimately) for vets, I am not looking for a handout, just what I am legally entitled to kind of thing. Dr. Ellis. My original on the job knee injury occurred in 2019. In 2024 my doctor to me that I was at MMI and recommended that I have an impairment rating. My lower extremity impairment raging came back as 13%. Here is my question. Does my calculated payment percentage derive from my 2019 salary, or my current salary when I filed the CA-7? Are there any limitations on getting a schedule award if it is federal law-enforcement which requires yearly physical and fitness tests. Some fed employees that are hurt feel like if they file and get a certain percentage, they will be let go even if they can still pass the tests. I am 50% rated. Back on May 22, 2024, I visited your office and had 4 Nexus letters written for my neck pain, secondary back, SC right knee and secondary left knee by your team.
